This is going to be a long comment, as the transaction went from good to bad.
When I first contacted Brett regarding the laptop, we negociated the price and we talked to the point because of his low heatware references, I would pay half of the ammount first and upon arrival of the PB, I will pay the rest.
Brett sent it next day and that was great! The product arrived at my front door from UPS, but no one was home at the time. UPS decided to leave the shipment in front of my home, where any passerby can walk up and take it. Someone did do that because by the time my brother came back from his late shift, he did not see a package.
I email Brett when I found out about this at home. Questioning the neighbors if they took it, they said they did not see a package dropped off my home (most of my neighbor are old, retired folks).
Brett said that he had the package insured, so I would at least get my money back. Having said that he needed to make a purchase for a TV ASAP, so out of good faith (and full knowing that I will receive my money back from the insurance). He starts a claim thru the UPS store that he shipped it from and a few days later, the same UPS driver comes by and checks to see if the package is around my home. My brother was home on his 3rd attempt to retrive the package and he signed the agreement with UPS saying that no package was received.
Brett files a claim with UPS on 10/23/05 and mentions that he is waiting on UPS HQ to come back with the check.
Emailing Brett in December and the beginning of January, but he said that the check was not received.
This was getting out of hand as time went on for way too long, and his very troubled lack of communication through Private Messages on AT and emails and AIM messages were ignored. (I clearly saw he was online)
I had to create a thread on Anandtech ForSale forums which can be found here: http://forums.anandtech.com/messageview.aspx?catid=45&threadid=1789827 in order to get any kind of communication with Brett. After the thread was posted, I decided to do some sluething and call UPS to see when the check was issued to Brett. According to UPS, it was issued on 12/9/05. That meant he had the check for over a month and a half!~~!!
Later on that night, he contacted me via phone... here is a cut-and-paste of the basic rundown of the conversation.

Got back home and noticed received calls from 248 area code, it\'s Brett.
After getting in touch with him over the phone, we talked and I explained that I was patient and had overlooked this transaction from my other life happenings like my vacation and what not. He explained to me that he could not understand why the laptop was not in my pocession and said that even UPS said it was in my pocession.
To make a long story short, he apologized to me personally and was very sincere in his words. He acknowledged that he bought the TV in the pictures and says that he used the money for the laptop for it. I kept trying to make him understand that he was not losing a laptop and $1500. He did not want to get me mad, nor was I at that point, but I did not understand why he didn\'t understand the logic. I had trouble following the cash transaction in the beginning, but the truth is this in a simplier terms that I told him..
I bought a box of cookies from Brett for $2. It gets lost in the mail and UPS reimburses you $2. You send mje back my $2. We bought have our original monies, but the cookie is still lost.
Anyways, it\'s getting late and he promised after the conversation that he is sending the $1500 in Paypal via eCheck. I have logged into my account and see that it is pending and will clear on Feb 1, 2006.
When this does clear and the money is in my account, this thread will be closed. Until then, the mods can keep it as sticky if need be..

Update: 01/28/06-
Update: Spoke with Brett last night and well, his whole point of the conversation was that he felt his responsibility as a seller ended when he shipped it off to UPS next day. Half-true though, so I rebutted that the responsibility as a seller does not end at that point, it only ends when the product has arrived safely in the person\'s hand (not front door) and if anything happens within that process (if the item broke during the shipping, or never got into the hands of the buyer because of the shipping company) then it is the responsibility of the seller to follow up with the shipping company and open a claim.
As a buyer, I cannot open a claim with UPS only the seller could. No one is blaming you for stealing the product off my porch. Others on the online community and myself are causing a fuss because of the lack of communication between me and you and the fact that you had the UPS insurance check for 17 days, during which I had tried to contact you numerous times without any success. We spoke back and forth regarding this point and then I finally said this:
\"Alright, it boils down to this. Simple math. You have the $1475 that I sent to you in the beginning. You also have the $1500 from UPS. You filed a claim with UPS stating that the laptop got lost. I, on the other hand, have no laptop and am out $1475. Is that fair?\"
No one is blaming Brett for what happened at the beginning of the transaction. Yes, he kept his word and sent it out next day via UPS. I think everyone can agree that he did a great job at that point.
The point that it turns south for Brett is the last 2 months of misinterrpretation and lack of communciation on his part.
Well, like I told Brett, I am a man of my words and what I say is without any flame or beef. Honestly, if it were other online traders, they would be causing a MUCH huger uproar, with frequent cussing and what not involved. I, on the other hand, like to keep things in a communication state, where emotions are leveled and we can all talk one on one.
The eCheck is still in my paypal account and pending until Feb 1st.

Update: 01/31/06 - No update, but that\'s good news. Money still waiting to clear in paypal...

Feb 1st. The paypal money was finally returned to my account, almost 4 months after my payment... It\'s unfortunate that I had to take it to AT thread to get my money back... this is surely unexcusable.
Overall, the bad points (slow and lack of communication, holding out on the money which is not rightfully his) overshadows the good points (good communication, in the beginning).
I would definately not trade with him again, and watch out for this trader.February 6, 2006
